Terms, Conditions and Policies updated 2/4/2024

OTHER INFO INCLUDED IN PACKAGES:

•All printed materials will be delivered 1-2 hours prior to the start of services for the deceased at the location specified on this form

•All printed copies will be sectioned in groups of ten (10) to ensure an accurate count.

•All printed materials or funeral service rentals must be signed for by guarantor or by the person designated by the guarantor before any staff of Affordable Obituaries Printing can leave. This includes any passing out of programs, fans, prayer cards or etc.

• Images: To ensure maximum quality and avoid printing problems use JPEG, TIF, PNG, EPS images of the highest quality as possible when submitting photos of loved ones. These can be given in-person, emailed, text, or FB messenger.

•Proofs of printed materials will be sent to guarantor or designee within 5-7 days prior to services. "AOP" requires that any changes to the proof regarding errors be corrected and submitted back to AOP within 24hrs of receiving the proofs. (***"AOP" understands that acts of God and/or extenuating circumstances. Those will be evaluated on a case-by-case basis***)

•Deposits: all clients will be required to pay 50% of the total cost of all services that will be rendered upon signing the final contract. The paid deposit will be credited towards the full cost.

•**Final Payment** The final payment must be made 24 hours prior to the scheduled services. Payments can be made by the following: Apple Pay, Google Pay, Zelle, Venmo, Cash App, or Cash.

CHANGE OF DATE OR VENUE

Affordable Obituary Printing must be notified immediately of any changes in schedule or location as this will affect any printed materials and delivery of such. Notification of any changes can be made by phone text at 702-917-8946. If by phone call, please send written notice sent via email for documentation. It is the client’s responsibility to confirm all arrangements at least 5-7days prior to the event. In the event of change of address or contact information (time, etc.) as listed, you must notify Affordable Obituary Printing.

DEPOSIT

A non-refundable deposit is required to hold the date of your event. No mock-ups will start until a deposit is received. The balance of the complete package price must be paid at the date specified herein. If final payment is not received as set forth herein, Affordable Obituary Printing reserves the right to withhold delivery of any goods and or not setup any funeral service rentals until payment is received. Upon client’s signature and payment of deposit, Affordable Obituary Printing agrees to reserve the date and time specified. The deposit is applied towards the final contracted package price.

CANCELLATION

There shall be NO refund of deposit the signing of agreement due to work that will have already begun on the printed materials. If the date of the deceased services is moved from the original contracted date due to no fault of Affordable Obituary Printing. Affordable Obituary Printing will try to accommodate the family but to high demand of services of Affordable Obituary Printing this accommodation may not be met. Any other arrangements shall be discussed between the client and Affordable Obituary Printing. All arrangements will be put in writing. Cancellation must be in writing even if a phone call was made to inform Affordable Obituary Printing of the cancellation. The deposit can be transferable up to 180 days after cancellation. This will start on the date of the approved cancellation. The client agrees to not expect a new date to automatically be available. The client will be given the chance to reschedule but cannot be pushed ahead of other reserved clients.

FAILURE TO PERFORM

Due to the limited and subjective nature of the services Affordable Obituary Printing cannot be held responsible for funeral service rentals not received due to but not limited to, anyone in or at the funeral home, or by the church or location restrictions. Affordable Obituary Printing is not responsible for lost printed materials due the scheduling complications due to lateness of individuals rules and restrictions of venue. Affordable Obituary Printing will do their very best to fulfill all requests but can make no guarantees. Clients are responsible for all location and permits.

UNFORESEEN CIRCUMSTANCES CLAUSE

If Affordable Obituary Printing or its representatives, cannot perform this agreement due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, or due to the Affordable Obituary Printing representative’s illness, then Affordable Obituary Printing shall return any monies paid by the client, less expenses, but shall have no further liability with respect to the agreement. This limitation of liability shall also apply if printed materials are damaged in processing, lost through compact flash card malfunction, or otherwise lost or damaged without the fault on the part of Affordable Obituary Printing.

CONSULTATION

It is HIGHLY required for the client to schedule a consultation before the service-date to finalize the actual printed materials and/or rental services. Affordable Obituary Printing can successfully communicate all service details via email or phone. If the client requests to meet in-person, they must be willing to meet near the at a mutual location. All Affordable Obituary Printing representatives travel in teams of two.

OBITUARY FORM

The client will be given an obituary form to fill out, the client is responsible for communicating all information on this form. ONLY THE INFORMATION ON THIS FORM WILL BE USED FOR PRINTED MATERIALS AND ANY SOCIAL MEDIA ADS. It is imperative that this form is updated regarding the family’s deceased loved on.

COPYRIGHTS

All printed materials or funeral rental services created by Affordable Obituary Printing are copyright protected. It is a violation of federal copyright law to copy, scan, or allow exact recreations/duplicates/copies/photographers created by Affordable Obituary Printing to be reprinted, duplicated, digitally reproduced, copied, scanned, or altered digitally or otherwise, without Affordable Obituary Printing’s express written permission. The client may print (on their own) their personal photographs or make a copy of paid printed materials with the written consent of Affordable Obituary Printing only once in possession of of those materials. Clients will NOT a digital copy of printed materials.

Affordable Obituary Printing agrees to grant these image rights to the client with a non-exclusive, limited, perpetual license.

This license allows the client to do the following with the images:

i) Display the images;

ii) Print the images;

iii) Publish the images on personal websites or social media websites

*This applies only if giving Affordable Obituary Printing credit. A description must be made by the client stating, ‘Copyright Affordable Obituary Printing Please do not copy/paste or edit in any way’.

THIS LICENSE WILL PROHIBIT THE CLIENT FROM DOING THE FOLLOWING:

APPLYING FOR COPYRIGHT REGISTRATION OR SELLING OF ANY IMAGE OR ELECTRONIC FILES SUPPLIED BY AFFORDABLE OBITUARY PRINTING MAKING ‘DERIVATIVE WORKS’ OR OTHERWISE MODIFY, INCLUDING EDITING AND/OR MANIPULATING ELECTRONIC FILES

PROOFS

Affordable Obituary Printing, a printing service and creative artist with whom Clients entrusts creative vision, retains the judgment to remove any image(s) from the proofs that it deems bad or irrelevant. Such as but not limited to pornographic, violent, gang-related, hateful, racist, and etc.…

EXPENSE REIMBURSEMENTS

The client agrees to reimburse Affordable Obituary Printing for all reasonable expenses relating directly to the funeral service itself. For example, parking fees, destination travel fees: A gas fee of $15 will be applied if the funeral service delivery location is over 30 miles outside the Las Vegas, NV area. Outside 60 miles of Las Vegas, NV is a $30 fee. Outside 75 miles of Las Vegas, NV is a $45 fee.

RETURNED CHECKS

Returned checks are subject to a $25 returned check fee. Client assumes responsibility for any and all collection costs and legal fees incurred by Affordable Obituary Printing in the event that enforcement of this contract becomes necessary. All legal action shall take place in Las Vegas, NV.

CREATIVE LICENSE

Images may be edited at the Affordable Obituary Printing discretion, and delivered images may not include all images shot. Affordable Obituary Printing reserves the creative right to edit and release only those deemed professional in quality and within Affordable Obituary Printing’s artistic standards. By signing this contract, the client is aware of the style of Affordable Obituary Printing produces.

COOPERATION

The parties agree to positive cooperation and communication.

TERMS/CONDITIONS

*Offerings [excluding prices] are subject to change without notice. The most up to date contract will immediately apply to any client that has already signed.

STORAGE OF IMAGES

Hard copy mages that were given to Affordable Obituary Printing will be returned to the person guarantor or designated person within 7days of final payment being made. The envelope must be signed for upon receiving imagines back. Affordable Obituary Printing does not guarantee the return of the photographs condition. The client understands this and accepts full responsibility. Permission is hereby granted to Affordable Obituary Printing to use any images created under this contract for professional samples, displays, internet website pages, advertising, exhibitions, contests, and any other purpose. The laws of Nevada shall govern this agreement.
